Terms of Service

These Terms of Service govern your use of ChatStyle, the customizable Twitch chat overlay platform operated at chatstyle.gg. By accessing or using the platform, you agree to be bound by these terms.

1. Scope & Operator

These Terms of Service ("Terms") apply to all services provided through the ChatStyle platform at chatstyle.gg ("Platform"), including the website, overlay system, template and skin designer, marketplace, and all related tools and APIs.

These Terms apply to all users of the Platform, including visitors, registered viewers, and streamers. By creating an account or using the Platform, you confirm that you have read, understood, and agree to these Terms in their entirety.

2. Definitions

• "Platform" — the ChatStyle website, overlay runtime, designer tools, APIs, and all associated services at chatstyle.gg.
• "User" — any person who accesses or uses the Platform, whether registered or not.
• "Streamer" — a registered user who integrates ChatStyle overlays into their Twitch broadcast and may manage templates, skins, and viewer permissions.
• "Viewer" — a registered user who customizes chat bubble appearances within the parameters set by the streamer they are watching.
• "Template" — a chat bubble design framework that defines the visual structure and available customization options for chat messages in an overlay.
• "Skin" — a visual variation of a template that applies a specific set of style overrides (colors, fonts, borders, effects) to a template.
• "Digital Product" — any digital good available for purchase on the Platform, including premium templates, skins, and any future digital content offered through the marketplace.
• "Subscription" — a recurring paid plan that grants a streamer access to premium features on a monthly billing cycle.
• "Content" — any material uploaded, created, or submitted by users through the Platform, including custom skins, templates, and configurations.
• "Marketplace" — the section of the Platform where creators can offer Digital Products for sale to other users.

3. Registration & Accounts

Eligibility

You must be at least 16 years of age to create an account and use the Platform. By registering, you confirm that you meet this age requirement. If you are between 16 and 18 years of age, you confirm that you have reviewed these Terms with a parent or legal guardian.

Account Creation

Registration is performed exclusively through Twitch single sign-on (SSO). By authenticating with Twitch, you authorize ChatStyle to access your basic Twitch profile information as required to provide the service.

Account Responsibility

You are responsible for all activity that occurs under your account. You must:

• Keep your Twitch account credentials secure.
• Notify us immediately if you become aware of unauthorized access to your account.
• Not share, transfer, or sell access to your account.

We reserve the right to refuse, suspend, or terminate accounts at our discretion, including for violation of these Terms.

Account Deletion

You may request deletion of your account and associated data at any time by contacting us via the details provided in our Imprint. Account deletion is permanent and cannot be reversed. Any active subscriptions must be cancelled before account deletion. Purchased Digital Products are forfeited upon account deletion.

4. Service Description

ChatStyle provides a platform for customizable Twitch chat overlays. Core services include:

• Overlay System — a browser-based chat overlay that streamers add to their broadcasting software (e.g., OBS Studio) to display stylized chat messages on stream.
• Template & Skin Designer — visual tools for creating and customizing chat bubble designs with adjustable settings for colors, typography, spacing, borders, and effects.
• Viewer Customization — viewers can personalize their chat bubble appearance within the boundaries defined by the streamer whose channel they are in.
• External API — an API that allows third-party tools and chatbots to interact with ChatStyle overlays programmatically.
• Marketplace — a platform for creators to sell custom templates and skins to other users.

The Platform may include features in beta or early access. Beta features are provided without warranty and may be modified, limited, or discontinued at any time.

5. Subscriptions & Payments

Subscription Tiers

ChatStyle offers paid subscription plans for streamers. Subscription tiers and pricing are displayed on the Platform and may be adjusted over time. Current tier pricing is based on channel subscriber count. All prices are in Euros (EUR) and include applicable taxes where required by law.

For each renewal, the applicable tier and price are determined from the verified Twitch subscriber count checked 3 days before the next payment. That tier and price apply from the next billing period. Changes in subscriber count do not create automatic mid-cycle charges, and you may cancel before renewal through your account settings.

Payment Processing

All payments are processed through Mollie B.V., a licensed European payment service provider. By making a purchase, you also agree to Mollie's terms of service. ChatStyle does not store your payment details — these are handled entirely by Mollie.

Renewal & Cancellation

Subscriptions renew automatically at the end of each billing period (monthly) unless cancelled. You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription remains active until the end of the current paid billing period.
• No partial refunds are issued for unused time within a billing period.
• Premium features revert to free-tier functionality after the paid period ends.

Failed Payments

If a recurring payment fails, we may retry the charge. If payment cannot be collected after reasonable attempts, your subscription may be downgraded or suspended. You remain responsible for any outstanding amounts.

6. Digital Products & Purchases

The Platform offers Digital Products for purchase, including premium templates, skins, and other digital content. When you purchase a Digital Product, you receive a limited, non-exclusive, non-transferable license to use that product within the ChatStyle platform.

Your license to use purchased Digital Products:

• Is valid only within the ChatStyle platform and overlay system.
• Does not grant ownership of the underlying design, code, or intellectual property.
• May not be sublicensed, resold, or redistributed outside the Platform.
• Remains active as long as your account is in good standing.
• Is revoked if your account is terminated for violation of these Terms.

Prices for Digital Products are displayed in Euros (EUR). We reserve the right to change prices at any time; changes do not affect previously completed purchases.

7. Marketplace

The ChatStyle Marketplace allows registered users ("Creators") to design and sell Digital Products to other users. By listing a product on the Marketplace, you agree to the following terms.

Creator Obligations

• You must own or have full rights to all content in your Digital Product.
• Your products must not infringe third-party intellectual property, violate applicable laws, or contain malicious code.
• You must accurately describe your products and not mislead buyers.
• You are solely responsible for the quality and legality of your products.

Revenue Sharing

When a Digital Product is sold through the Marketplace, revenue is shared between the Creator, the Platform, and — where applicable — the reselling Streamer. Current revenue share rates are published in your creator dashboard and apply at the time of each sale.

Revenue shares are calculated on the net sale price after payment processing fees. Payout schedules, minimum thresholds, and methods are specified in your creator dashboard. We reserve the right to adjust revenue share rates with reasonable advance notice.

Product Availability & Removal

Once a Digital Product has been purchased by any user, the Creator may deactivate it to prevent future sales but may not delete it from the Platform. Purchased products must remain available to buyers who already own them. If a Creator's account is terminated, purchased products remain accessible to their buyers.

We may remove any Marketplace listing that violates these Terms, infringes third-party rights, or is reported and found to be in violation. Buyers who purchased a removed product retain their license to use it.

8. User Content

Your Content

You retain ownership of Content you create and upload to the Platform. However, by submitting Content, you grant ChatStyle a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your Content as necessary to operate and promote the Platform. This license persists for the duration of your use of the Platform and for a reasonable period after account deletion to fulfill existing obligations (e.g., purchased products).

Content Standards

You must not upload, create, or distribute Content that:

• Infringes copyrights, trademarks, or other intellectual property rights of third parties.
• Contains hate speech, harassment, threats, or discriminatory material.
• Is sexually explicit, excessively violent, or depicts illegal activity.
• Contains malware, scripts, or code intended to disrupt the Platform or harm users.
• Impersonates another person or misrepresents your affiliation with any entity.
• Violates Twitch's Community Guidelines or Terms of Service.
• Violates applicable German or European Union law.

We reserve the right to remove any Content that violates these standards without prior notice.

9. Intellectual Property

All rights to the Platform — including its source code, design, templates, branding, logos, documentation, and underlying technology — are owned by the operator or licensed to us. These rights are protected by copyright, trademark, and other intellectual property laws.

You receive a limited, non-exclusive, non-transferable, revocable license to use the Platform in accordance with these Terms. You may not:

• Copy, modify, or create derivative works of the Platform's source code or design.
• Reverse engineer, decompile, or disassemble any part of the Platform.
• Remove, alter, or obscure any proprietary notices or labels on the Platform.
• Use ChatStyle's name, logo, or branding without prior written consent.

Default templates and system skins provided by ChatStyle remain our property. Your license to use them is subject to these Terms and your account status.

10. Prohibited Conduct

When using the Platform, you must not:

• Attempt to gain unauthorized access to accounts, systems, or data.
• Use automated tools (bots, scrapers, crawlers) to access or interact with the Platform without written permission.
• Interfere with, disrupt, or overload the Platform's infrastructure or services.
• Circumvent security measures, access controls, or rate limits.
• Use the Platform for fraudulent activity, money laundering, or other illegal purposes.
• Abuse the payment system, including initiating unjustified chargebacks.
• Create multiple accounts to circumvent bans, restrictions, or limitations.
• Exploit bugs or vulnerabilities instead of reporting them responsibly.
• Use the Platform in any way that violates Twitch's Terms of Service.

Violation of these rules may result in immediate account suspension or termination, removal of Content, and potential legal action.

11. Right of Withdrawal

If you are a consumer within the European Union, you generally have a 14-day right of withdrawal for online purchases under the Consumer Rights Directive (2011/83/EU). The full withdrawal policy and model withdrawal form are available on our Right of Withdrawal page.

For subscriptions, the withdrawal period begins on the date of the initial purchase. If you request withdrawal within 14 days and have not yet used premium features, we will issue a full refund. Once premium features have been accessed, the right of withdrawal is waived.

To exercise your right of withdrawal, contact us via the details provided in our Imprint with a clear statement of your decision. A withdrawal form is not required but must include your account information and purchase details.

12. Availability & Modifications

We strive to maintain high availability but do not guarantee uninterrupted, error-free, or secure access to the Platform. The Platform may be temporarily unavailable due to:

• Scheduled or emergency maintenance.
• Infrastructure failures or third-party service outages.
• Force majeure events beyond our reasonable control.

We reserve the right to modify, update, or discontinue features of the Platform at any time. For significant changes that affect paid services, we will provide reasonable advance notice. If a paid feature is permanently discontinued, affected subscribers will receive a pro-rata refund for the remaining paid period.

13. Liability Limitations

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law:

• We are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
• Our total aggregate liability for any claims related to the Platform is limited to the amount you paid to us in the 12 months preceding the claim, up to a maximum of €100.
• We are not liable for loss of data, revenue, or business opportunities resulting from Platform use.
• We are not responsible for user-generated Content or third-party services integrated with the Platform.

These limitations do not apply to liability arising from intent, gross negligence, injury to life, body, or health, or mandatory statutory liability that cannot be excluded under German law.

14. Indemnification

You agree to indemnify, defend, and hold harmless the operator and their affiliates from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of:

• Your use of the Platform or violation of these Terms.
• Content you create, upload, or distribute through the Platform.
• Your infringement of any third-party rights, including intellectual property rights.
• Your violation of applicable German or European Union law.

15. Termination

By You

You may stop using the Platform at any time. To close your account, cancel any active subscriptions and contact us via the details provided in our Imprint. Deletion of your account does not entitle you to a refund for past purchases.

By Us

We may suspend or terminate your account at any time if:

• You violate these Terms or applicable laws.
• Your conduct harms other users, the Platform, or third parties.
• You initiate an unjustified chargeback against the Platform.
• We are required to do so by law or regulatory order.

For non-breach termination initiated by us, we will provide reasonable notice and issue a pro-rata refund for any active subscription within 30 days. Termination for violation of these Terms does not entitle you to any refund.

Effects of Termination

Upon account termination:

• Your access to the Platform and all associated services is revoked.
• Your license to use purchased Digital Products is terminated.
• Content you created may be removed from the Platform.
• Sections of these Terms that by their nature should survive termination (including liability limitations, indemnification, and intellectual property) remain in effect.

16. Data Protection

Your privacy is important to us. The collection, processing, and use of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Platform, you consent to data practices described in the Privacy Policy.

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable German data protection law (BDSG).

17. Third-Party Services

The Platform integrates with and relies on third-party services. By using the Platform, you acknowledge the following:

• Twitch — authentication, chat data, and broadcaster information are provided through Twitch's API. You must comply with Twitch's Terms of Service when using ChatStyle.
• Mollie — payment processing is handled by Mollie B.V. Your payment data is subject to Mollie's User Agreement.

We are not responsible for the availability, accuracy, or practices of third-party services. If a third-party service becomes unavailable or changes its terms, related Platform features may be affected without liability on our part.

18. Changes to Terms

We may update these Terms from time to time. When we make material changes:

• We will publish the updated Terms at least 14 days before they take effect.
• The updated Terms will include a new effective date at the top of this page.
• You will be asked to review and accept the updated Terms upon your next login after changes are published. If you do not accept, you may not continue using the Platform.

For minor corrections (typos, formatting, clarifications that do not affect your rights), we may update without prior notice.

If you do not agree to the updated Terms, you may cancel your subscription and stop using the Platform before the changes take effect. If changes materially reduce your rights under an active paid subscription, you may terminate and receive a pro-rata refund for the remaining period.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of your country of residence remain unaffected.

Dispute Resolution

We encourage you to contact us first to resolve any disputes informally. If a resolution cannot be reached:

• For consumers within the EU, the European Commission's Online Dispute Resolution (ODR) platform is available at https://ec.europa.eu/consumers/odr.
• We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board, but may choose to do so on a case-by-case basis.
• For all other disputes, the courts at the operator's place of business have jurisdiction, unless mandatory law provides otherwise.

20. Final Provisions

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid provision will be replaced by a valid provision that most closely reflects the original intent.

Entire Agreement

These Terms, together with the Privacy Policy and any supplementary terms referenced herein, constitute the entire agreement between you and the operator regarding your use of the Platform.

No Waiver

Failure by us to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
